Start with the notice and the underlying council account

Equita may be instructed after a council has obtained a liability order for unpaid business rates. At that point, the amount requested can include the original rates balance, court costs and enforcement fees. A discussion about instalments is more effective when you know exactly what each part of the balance relates to. We can help you check the rating years involved, the property and liability period, payments already made and whether any relief, exemption or account correction remains unresolved. If the balance appears broadly correct, we can help you organise the information needed for an affordable proposal. If something appears wrong, we can identify which issue should be raised with Equita and which must be taken directly to the council or the VOA.

When Equita will not accept your offer

A low or unsupported offer may be rejected, particularly where the enforcement stage is advanced. Prepare a proposal that explains the business position, the amount available, the payment frequency and the date payments can begin. Avoid offering more than the business can maintain simply to end a difficult call. We can review your proposed figures and supporting information and help you present the request clearly. Acceptance remains a decision for Equita and the instructing council, and no adviser can promise a particular arrangement.

  • An up-to-date income and expenditure summary or cash-flow forecast.

  • A clear statement of the amount you can pay immediately and regularly.

  • Evidence of trading disruption or a temporary cash-flow problem, where relevant.

  • Confirmation of any ongoing dispute, relief application or account correction.

  • A record of previous payments and any earlier arrangement.

Read every notice carefully and do not dispose of or hide documents. Ask for an itemised statement and keep a written record of calls, payments and visits. Do not sign an agreement you do not understand.
